1.2 This Privacy Policy (“Privacy Policy”) is published in accordance with: (i) Section 43A of the Information Technology Act, 2000; (ii) Regulation 4 of the Information Technology (Reasonable security practices and procedures and sensitive personal information) Rules, 2011 (“SPI Rules”); and (iii) Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, that require publishing the privacy policy that is applicable in relation to the access or usage of (“Website”).

1.3 This Privacy Policy covers: (i) the type of information collected from the users through the Website including sensitive personal data or information; (ii) the purpose, means and modes of usage of such information; and (iii) how and to whom such information which has been collected will be disclosed.

1.4 For the purpose of this Privacy Policy, wherever the context so requires "You", “Your” or “User” shall mean any natural or legal person who uses the Website for availing services offered by the Website (“Services”). The terms “We”, “Us”, and “Our” shall mean “com”.

1.5 We reserve the right to make changes to this Privacy Policy at any time. We will provide notice of any significant changes through the Website, or by other means so that you may review the changes before you continue to use the Website. Any such modifications will become effective immediately upon posting to the Website and your continued use of the Website, and/or the Services constitutes your consent to such modifications. If you object to any changes, you may close your account. You agree to periodically review the current version of the Privacy Policy as posted on the Website.

  1. Type of information collected from the customer

2.1 For the purpose of this Privacy Policy, “personal information” as defined under Section 2(i) of the SPI Rules means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person.

2.2 “Sensitive personal information” as defined under Section 3 of the SPI Rules means such personal information which consists of information relating to:

  • password;
  • financial information such as Bank account or credit card or debit card or other payment instrument details ;
  • physical, physiological and mental health condition;
  • sexual orientation;
  • medical records and history;
  • biometric information;
  • any detail relating to the above clauses as provided to body corporate for providing service; and
  • any of the information received under the above clauses by body corporate for processing, stored or processed under lawful contract or otherwise.

2.3 We require Customers who avail our service through the Website to provide us with the following information:

  • Name of the Customer
  • E-mail Address
  • Phone Number
  • Address
  • Credit card or debit card information which is required for payment purposes.
  • Demographic information such as postcode, preferences and interest
  • All other information as required by Us to register/ provide the Service to the Customer on the Website.

2.4 We require the Vendors who avail our service through the Website to provide us with the following information:

  • Name of the Vendor
  • E-mail Address
  • Phone Number
  • Postal Address
  • Tax-Payer Identification Number
  • All other information as required by Us to on-board the Vendor on the Website.
  1. How the collected information will be used

3.1 Sensitive Personal Information and other information collected Clause 2 shall be used in the manner described below: 

  • Registered user name: The registered user name shall be used to customize the Services availed by the user through the Website and to personalize all communications that are sent to the user by us. 
  • E-mail Address: Your E-mail address will be used to communicate:

               - Confirmation of your order booking;

               - Details regarding payment for the orders placed;

               - Feedback from customers regarding the products and services provided by us; and

               - Communication of delivery of orders placed by you.

  • Phone Number: Phone number will be an alternative method to contact the user for any matter related to the services to be availed by you.
  • Address: The address can either be your residential address or official address or the address of the receiving party to whom the consignment is transported. The same shall be provided to the driver of the vendor carrying the consignment in order to deliver the consignment at the location specified by the user on the Website. 
  • Credit Card/Debit Card information: Credit Card/Debit Card information is used for charging the user for making purchases on the website. 
  • The Tax-Payer Identification Number collected from the Vendors shall be used to verify the Vendor and to generate an invoice. 
  • In order to improve the quality of our Services we may ask you to provide us with information regarding your experiences with our products and/or services. Users have the option of choosing not to provide us with this information. 
  • We will use your registered account transaction information which includes all information pertaining to your registered account activity, Products ordered, payments made, orders cancelled, modified and the like and communications pertaining to the same in order to assess the credibility of the user. 
  • We may use your information to send you promotional information pertaining to the Products and/or Services provided by us. 
  • We reserve the right to ask you, at the time of registration with the Website or thereafter, for documentary proof of your identity or other data or postings provided by you with respect to the registration or otherwise. In the event that you fail to provide us with this information or documentary proof, we reserve the right to refuse registration or to terminate your user agreement immediately and cease to provide any Services to you.
  1. Disclosure of Personal Information

4.1 All financial information that is collected through the Website is used solely to bill for the services availed by the user, and is not used for marketing or promotional purposes. Towards this end, we disclose such information to a third-party intermediary, for the sole purpose of credit card processing, which is used to make payments to avail of the services on our Website.

4.2 We may also disclose certain information to third parties solely to help diagnose technical problems, to administer the Website, and improve the quality of the Services provided by us.

4.3 We reserve the right to disclose any personal information as required by law and when we believe, at our sole discretion that disclosure is necessary to protect our rights, protect someone from injury and/or to comply with a judicial proceeding, court order, or legal process served on our Website.

5.1 The Website uses temporary cookies, which are files that your web browser puts on your system when you visit a website, to store certain information that is not sensitive personal information. The information collected through these cookies is used by us for the technical administration of the Website, research and development, and to improve the quality of our services.

5.2 We may use third party cookies to track visitor behaviour and to improve the quality of our services. However, such cookies will not store any kind of personal information, nor will such information be disclosed to any third party.

5.3 These cookies are intended to be automatically cleared or deleted when the User quits the browser application. We may provide links to websites for the convenience and information of users. These websites may not be owned, controlled, or operated by us. In those cases, we cannot control how information collected by those websites will be used, shared, or secured. If the user visits linked sites, we strongly recommend that the user reviews the privacy notices or policies posted at those sites. We are not responsible for the content of linked sites, the user’s use of them, or the information practices of their operators.

  1. Security Procedures

We have implemented industry standard security policies, rules and technical measures as required under Section 8 of the SPI rules, to protect any kind of personal sensitive information that we have under our control from unauthorized access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss.

  1. Retention of Information

We retain any personal information that you may have provided to us, for as long as you engaged our services, and for a reasonable time thereafter. Upon request, we will provide you with a copy of your personal information which we keep with us, after providing us with proof of your identity.

  1. Choice/Opt-Out

Should the clients not be desirous of receiving promotional, marketing & other non - essential communication from MASN, they may choose so once their account has been set up. Once a client unsubscribes from our website, the relevant contact details are removed from all mailing lists.

  1. Grievances

If you have any grievances as to the usage of any of your personal information or any other privacy concerns, you can contact the Grievance Officer whose details are provided herein, who will redress any such grievance that you might have within a period of 30 (Thirty) days. 

Any & all grievances associated with the use of your personal information can be addressed to our Grievance Officer who shall endeavour to revert within a period of thirty (30) days.

  1. Governing Law and Jurisdiction

The Privacy Policy shall be governed by and constructed in accordance with the applicable laws of India without reference to conflict of laws principles. Courts in Mumbai, India shall have the exclusive jurisdiction to determine any disputes arising in relation to, or under, this Privacy Policy.

1.4 These terms of usage (“Terms of Use”) govern Your use of the Website and Services (as defined below) provided through the Website. By using or visiting the Website, or by using any content or information provided as part of the Website/Services, You shall be deemed to have read, understood and accepted to be bound by these Terms of Use.

1.5 For the purpose of these Terms of Use, wherever the context so requires "You", “Your” or “Customer” or “Client" or “User” shall mean any natural or legal person who uses the Website for availing the Products and Services. The term “We”, “Us”, “Our” shall mean the Company, its employees, and authorised agents that perform any services on the Company’s behalf.

1.6 MASN reserves the right to make modify these Terms of Use at any time. Any such modifications will become effective immediately upon posting on the Website and the users' ongoing usage of the Website, and/or the Services embodies their acceptance of the modifications made. The clients agree to review the latest version of our Terms of Use as posted on the Website.

1.7 Customers who access the website illustrate the competence to acquire / buy the products as well as to engage in a the act of entering into a sale / purchase contract. The vendors who aspire to be listed as sellers with MASN demonstrate the propriety to be bound to MASN’s terms of usage.

  1. Services

2.1 Our Website is an Online Marketplace through which we enable Vendors to market, advertise and sell handicrafts & artefacts viz. wall art, sculptures, photographs, architectural elements, furniture, home décor items, or any other such products (“Product(s)”) to Customers (as elaborated below) subject to the clients' compliance with and acceptance of MASN's Terms of Use.

2.2 For the purposes of these Terms of Use,

Applicable Law” shall mean any statute, law, regulation, ordinance, rule, judgment, notification, rule of common law, Order, decree, bye-law, government approval, directive, guideline, requirement or other governmental restriction, or any similar form of decision of, or determination by, or any interpretation, policy or administration, having the force of law of any of the foregoing, by any Authority having jurisdiction over the matter in question, whether in effect as of the date of these Terms of Use or thereafter;

Authority” shall mean any national, state, provincial, local or similar government, governmental, regulatory or administrative authority, branch, agency, any statutory body or commission or any non-governmental regulatory or administrative authority, body or other organization to the extent that the rules, regulations and standards, requirements, procedures or Orders of such authority, body or other organization that have the force of Applicable Law or any court, tribunal, arbitral or judicial body in India;

Customer” shall mean any any natural or legal person who uses the Website to purchase the Products that are being sold by the Vendor on the Website;

"Vendor” shall mean any natural or legal person who uses the Website to market and sell the Products to the Customers.

  1. Platform for Customers and Vendors:

3.1 This Website acts as a facilitator between the Vendor and Customer for the purchase of Products. A Customer may purchase Products on the Website without mandatorily registering on the Website, by providing the relevant details as necessitated. However, in order to gain access to our exclusive Product listings, the Customers must register themselves on the Website (“Registered Customer(s)”). Such Registered Customer’s details may be verified by the Website by a detailed process which may even include a detailed telephonic conversation between the Website and the Registered Customer. Every Registered Customer shall allocate themselves a unique identification user name and password ("User ID" and "Password").

If the clients use the Website as Registered Customers, the clients are responsible for maintaining the confidentiality of their User ID and Password. They are responsible for all activities that occur under their User ID and Password.

The client (whether or not a Registered Customer) agrees, inter alia, to provide true, accurate, current and complete information about oneself as prompted by the Website registration form. If the client provides any information that is untrue, inaccurate, not current or incomplete or MASN has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, MASN reserves the right to indefinitely suspend, terminate or block / refuse to provide the said client with access to the Website. 

3.2 MASN is neither a party to, nor in control in any manner any transaction between the Vendors and clients for the purchase of Product (s).

3.3 All commercial / contractual terms including price, payment methods, time period of delivery, packaging costs, shipping costs, mode of delivery, payment obligations, warranties related to Products and return and refund policy of the Products are offered by and agreed to between Customer and Vendor alone. MASN does not have any control and neither does it determine in any way, the offering or acceptance of such commercial / contractual terms between the Customer and Vendor.

3.4 MASN does not make any representation or warranties as to the specifics of the Product (s) proposed to be sold or offered to be sold or purchased on the Website. MASN does not accept any liability whatsoever for any errors or omissions, whether on behalf of itself or third parties.

3.5 MASN is not responsible for any non-performance or breach of any contractual agreement entered into between Customer and Vendor. We shall not be required to mediate or resolve any dispute or disagreement between Customer(s) and Vendor(s). However, We shall take all reasonable steps to try and ensure a peaceful and amicable settlement between the Vendor and Customer.

3.6 MASN does not, at any point of time, during any transaction between Customer and Vendor on the Website come into or take possession of any of the Product (s) offered by the Vendor nor does MASN, at any point of time, gain title to or have any rights or claims over the Product (s) offered by the Vendor to Customer.

3.7 MASN website is only a platform that can be utilized by Vendors to gain access to its Customer base to market and sell their Products, and for the Clients to gain access to curated Products being sold by the Vendors. At no time shall the Website hold any right, title or interest over the products nor shall it have any obligations or liabilities in respect of any such contract.

  1. Representations, Warranties and Obligations of the WebsiteWe hereby represent and warrant that (a) We are a duly registered private company as under the relevant provisions of the Companies Act 2013; (b) We are in compliance with the Applicable Law to provide Services, subject to these Terms of Use; (c) We will comply with the Privacy Policy and ensure data security of the Users at all times;

Representations, Warranties and Obligations of the Customer: The Customer hereby represents and warrants that (a) You are a natural or legal person, competent to contract, and have read, understood and agreed to be bound by these Terms of Use; (b) They shall provide accurate information and details at the time of registration; (c) They shall not default in making payments for Products bought from the Vendor through the Website; (d) They agree and acknowledge the fact that there shall be minor differences between the Product image and the Product in physical form; (e) They shall not demand for refund/ replacement of the Product for such minor variations; and (f) They agree and acknowledge that once the order has been placed on the Website for a Product, they shall not be allowed to cancel or modify the order.
  1. Intellectual Property Rights

6.1 Copyright

6.1.1 The copyrights, design rights (whether or not registered), moral rights, performance rights, database rights, new media rights, names, logos, publicity rights, and any and all other intellectual property and proprietary rights of any nature whatsoever that subsist, or may subsist, or be capable of registration, in each case in relation to the creative work of the Vendor, for all the Products listed by the Vendor rests with the Vendor. The Vendor hereby grants the Company a royalty-free, non-exclusive, worldwide, perpetual, irrevocable right and license to use, display, the creative works of the Vendor for the purpose of sale of the Product and promotion of the Website/ Company.

6.1.2 All Company’s content included on the Website, including but not limited to, text, graphics, logos, designs, photographs, button icons, images, video clips, digital downloads, data compilations etc., is Our property and is protected by the Applicable Laws with respect to intellectual property rights. The compilation of all content on this Website is Our exclusive property, and shall not be reproduced or used without express written permission from Us. We reserve the right to terminate our engagement with You, if We, in Our sole and absolute discretion, believe that You are in violation of this clause.

6.1.3 The content made available on or via the Website, is provided to You ‘AS IS’ for Your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without Our prior written consent. We reserve all rights, not expressly granted in and to the Website.

6.2 Trademarks is the domain of the Company. The Website, including, but not limited to its graphics, logos, page headers, button icons, scripts and service names constitute trade dress of the Company. The trademarks, domain names and trade dress of the Company shall not be used or reproduced without prior written approval from the Company, and may not be used in connection with any Product or Service that is not affiliated with the Company.

6.3 License and warranty for Your submissions to the Website

6.3.1 Any information submitted to MASN by the client, is at their own risk. By providing the said information, the client (s) represents and warrants that the client (s) is (are) entitled to submit it and that it is neither confidential nor is it not in violation of any law, contractual restrictions or any other third party rights (including any intellectual property rights).

7.1 The Website may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of the Website. MASN is not responsible for the content of any Linked Site, including, without limitation to, any link contained in a Linked Site, or any changes or updates to a Linked Site.

7.2 MASN is not responsible for any form of transmission, whatsoever, received by the client from any Linked Site. MASN provides these links only for the convenience of the client, and the inclusion of any such link (s) does not imply endorsement by the Website, of the Linked Sites or any association with its operator (s) or owner (s) including the legal heirs or assigns thereof.

7.3 On accessing the Linked Sites, the client shall be governed by the terms of use, privacy policy and such other additional policies of the Linked Sites. The client further acknowledges and agrees that MASN shall not be responsible for or liable for, directly or indirectly, any damage and / or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, advertising, products, services or other materials available on or through any Linked Sites or for any errors, defamatory content, libel, slander, omissions, falsehoods, obscene content, pornographic material, or any profanity contained therein.

  1. Payment Terms

8.1 The Customer on placing an order on the Website, shall be directed to a third party payment gateway (“Third Party Payment Gateway”). The Customer shall make payments for Products purchased through the Website through Net Banking/Credit Card/Debit Card/ Online Wallet or any other method provided by the Third Party Payment Gateway.

All payments for products purchased on MASN are via a secure third party payment gateway methods like Net Banking / Credit Card / Debit Card / Online Wallet or the likes. 

8.2 The Customer agrees and accepts that all nuances and modalities relating to making payment using Third Party Payment Gateway shall be separately governed by arrangement(s) / terms and conditions between You and the relevant banks/ Third Party Payment Gateway. We shall not be responsible, in any manner whatsoever, for any liability that may arise in relation to the payments made through Third Party Payment Gateway.

The process of making the payments via the third party gateway is governed by a separate set of terms & conditions between the client & the relevant party (ies). The client agrees to indemnify MASN for any and all liabilities that may arise in relation to the said transactions.

8.3 While availing any of the payment method(s) available on the Website, We will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to (a) Lack of authorization for any transactions; (b) Any payment issues arising out of the transaction or (c) Decline of such transaction for any reason. MASN shall not be responsible, nor shall it assume any liability for any loss or damage, whether immediate or latent, direct or indirect due to but not limited to: (a) Lack of authorization for any transaction (s); (b) Any payment issues arising out of any transaction (s) or (c) Decline of any transaction (s) for any reason.

8.4 The client understands, accepts and agrees that the payment facility provided MASN / the Website , is neither a banking nor financial service but is merely a facilitation service vide provision of an automated online electronic payment, collection and remittance facility for the transaction (s) between the Client and the Vendor via the Website using the existing authorized banking infrastructure and credit card payment gateway networks. By providing the said payment facility, MASN is neither acting as a trustee nor in any fiduciary capacity with respect to the payment (s) made by the client against the purchase of Product (s) made on the Website.

8.5 The Website reserves the right to refuse, to process any request for Service availed by a User with a prior history of questionable charges including without limitation, breach of any agreements by such User with MASN, or breach/violation of any Applicable Law.

8.6 You understand, accept and agree that all payments made by the Customer shall be to the Vendor based on the invoicing of the Vendor to the Customer. With respect to payments, Our role is limited to acting as facilitators in making payments from Customer to Vendor using Third Party Payment Gateway.

The client understands & agrees that any and all payments made are to the vendor (s) for the purchases made on the website. MASN’s part is limited to that of a facilitator between the vendor & the client using Third Party Payment Gateway.

8.7 Any Sales Tax, VAT or any other applicable taxes accruing out of the sale shall be borne by the Vendor.

  1. Modification and Cancellation/ Refund and Replacement

9.1 MASN shall not assent to any request for modification or cancellation of purchase / booked items.

9.2 Any and  all requests for refund / replacement shall be as per the terms of sale of the individual products, which are dictated  by individual Vendors in the Vendor Page on the Website.

9.3 Should there be a request for a refund, and should the same have been accepted by the vendor of the object in question, the refundable amount shall be electronically wired within 45 days’ time.

If the order is requested for refund, after payment has been processed, and if the refund is approved by the Vendor, the said amount will be refunded within a period of 45 (Forty Five) days through electronic payment.

  1. Privacy

The Website collects, stores, processes and uses Your information in accordance with Website’s Privacy Policy. By using the Website and / or by providing Your information, the user authorizes the collection and use of the information the user discloses on the Website in accordance with Website’s Privacy Policy. 

  1. Fraud and Improper Conduct

11.1 The user may only access the Website and use the Services offered for lawful purposes. The user is solely responsible for the knowledge of and adherence to any and all provisions of Applicable Law pertaining to its use of the Services. The user agrees that it will not in any way:

- interfere with the ability of others to access or use these Services;

- act in a manner that adversely affects other Users' ability to use the Website or the Services; or attempt to disrupt the normal flow of communication

- Interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies, or regulations of networks connected to the Services.

- Upload or post or use the Service to transfer, any content or other material that contain or constitutes viruses, Trojan horses or other codes with disruptive, malevolent and / or pernicious attributes.

- The user shall not attempt to gain unauthorized access to the account of any other User, or otherwise interfere with any other User’s use of the Service.

  • The user shall not use any false or misleading information (e.g., false or misleading names, email addresses or URLs) when using the service, including, without limitation, with respect to any identifying information for the users' account, and all information that the user provides must be accurate and correct, and the user must update any changes to such information as and when changes occur to keep the same pertinent.
  1. Limitation and Disclaimer of Warranty

12.1 The Website, the Services and each portion thereof are provided "AS IS" without warranties of any kind either express or implied. To the fullest extent possible pursuant to Applicable Law, We disclaim all warranties, express or implied, with respect to the Website, the Services and each portion thereof, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or other violation of rights.

12.2 MASN shall not be liable for any loss or damages suffered by the user / client due to any failure on the part of Vendor to supply the Product for any reason whatsoever, including but not limited to, partial or total damaged Product, incorrect Product, or other circumstances which may or may not be within the control of the Vendor.

12.3 MASN shall not be liable for any direct, indirect, incidental or consequential damages, whatsoever incurred by the user / client due to use of the Website’s Services or due to the non- availability of the Website Services.

12.4 If the user / client is dissatisfied or harmed by this Website or anything related with the Website, the sole remedy shall be to terminate these Terms of Use by unsubscribing on the Website.

12.5 MASN shall be entitled to disclose to the Authority, the particulars of the User engaged with the Website, as required by Applicable Law or by any directive or request from any government body, 

12.6 MASN shall be entitled to modify and / or amend any or all these terms and conditions at any time and the User shall be bound by such modification and / or amendment once such addition, variation or amendment is incorporated into these terms and conditions, and such amended terms and conditions are on the Website. 

  1. Indemnification

The client undertake to indemnify MASN, its officers & employees, for any losses or damages resulting from any third party claims or complaints arising from, or in connection with the clients’ actions on the Website, and / or breach of this Agreement.

  1. Termination

14.1 We may terminate these Terms of Use with respect to You, immediately without notice in the event of any breach by You of these Terms of Use or any of our applicable policies, as posted on the Website from time to time or upon a misuse of the Services by You.

14.2 The user agrees that upon the termination of these Terms of Use, MASN may delete all information related to the user with respect to the Services availed by the user. Further, the user will no longer be able to log into the Website.

  1. Severability

If any part of the Terms of Use are determined to be invalid or unenforceable pursuant to Applicable Laws, including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed to be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms of Use for Services shall continue in effect.
